The following standard terms of business apply to all instructions accepted by Kingfisher Wills. All work carried out in the provision of our Will writing services and associated advice is subject to these terms. Except where changes are expressly agreed in writing. These terms of business and obligations form the basis of the contract between Kingfisher Wills and the Client.
Terms Of Business
The Clients obligations are
- To disclose all relevant documents, facts and answers to all the questions asked to enable Kingfisher to provide accurate advice and to produce an effective legal document. Kingfisher shall not accept liability in respect of information or documentation which was not disclosed or information which is not accurate or true.
- To read through the draft documents provided to confirm they correctly reflect your wishes as to the distribution of your estate and that the names and addresses of the persons mentioned in your documents are correct, adding any missing data not supplied at the time of taking instructions
- To return any documents requested by Kingfisher with any amendments as soon as possible. If you fail to return the Documents to Kingfisher then Kingfisher shall accept no liability for the draft documents. The Company shall not be responsible for any delay due to your failure to comply with the above.
- To provide sufficient documentary evidence to enable Kingfisher to confirm your identity
- Payment of fees will be required in full on completion of the documentation to your satisfaction.
Kingfishers obligations and terms are
- To comply with your instructions using all due skill, care and expedition appropriate to your needs. Where time scales for preparation and execution are agreed in writing with you these will be adhered to by Kingfisher.
- To maintain the strictest confidentiality and not to pass on your details to any other person or organisation without your express written permission unless legally required to do so and shall comply with all legislation in force relating to data protection.
- To offer an attestation service that supervises the signing and witnessing of your Will in your home. Kingfisher will not take responsibility for ensuring the validity of your documents where the attestation service has not been taken up. In the event this service is not taken up documents will be sent to you with full written instructions as to how they should be completed. The signing of your documents must be carried out according to the laws of England and Wales in order for your documents to be valid. Kingfisher will check the documents for free after they have been signed to ensure validity. It is your responsibility to send the documents to Kingfisher after you have signed them if you would like to have them checked.
- To refund any money paid in respect of the preparation of your Will(s) should you change your mind within 14 days from the date of taking your instructions. After the expiration of this period Kingfisher reserves the right to charge you for the advice given and or work done on your behalf. An itemised bill will be produced for any charge falling due under this term.
- Kingfisher shall not be liable to you or be deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of Kingfishers obligations if the delay or failure was or is due to any cause beyond Kingfishers control or where you have failed to meet any of your obligations set out in these terms.
- Any advice that is given by Kingfisher is based upon its understanding of the law, practices and procedures at the date of signing your Will. Kingfisher is not responsible for any consequences arising from any future changes of law practice or procedure.
- The service provided by Kingfisher is restricted to the drafting of legal documents. Kingfisher does not provide financial or tax advice. Our advice is limited the legal implications of drafting such documents only.
- Each provision of these terms shall be construed separately and independently of each other and the validity of any one part shall not affect the validity of any other part.
